CEREBRAL PALSY

Cerebral Palsy (CP) can be caused by a lack of oxygen at birth due to a doctor’s negligence.  At Spector & Kopec, LLC, we are very experienced in evaluating medical malpractice cases on behalf of children with Cerebral Palsy.

DO ANY OF THE FOLLOWING APPLY TO YOUR CHILD?:

  • Did your baby have trouble breathing after birth and need resuscitation?

These can be signs that your baby suffered brain damage from a lack of oxygen at birth.

Many times, something happens during the mother’s labor that requires a doctor to do a c-section in order to prevent harm to the baby.  Sometimes the parents are aware of the condition, and other times we need to get the medical records in order to find out whether one of these conditions existed.  Here are some of the ones that we look for:

  • Did the fetal heart rate monitor show drops in the baby’s heart rate?
  • Did the doctor wait too long after the mother became full term to deliver?
  • Did the doctor wait too long to deliver after the mother’s water broke?
  • Did the doctor or nurses use the drug Pitocin during the labor in a way that caused difficulty to the baby during labor?
  • Did the doctor use a vacuum during the delivery in a way that caused harm to the baby?
  • Did the doctor and nurses let the mother push too long during the labor?

The presence of one or more of these conditions can require a doctor to do a c-section in order to avoid harm to the baby.
